1. Acceptance of Terms

By using the Tappy app, physical button device, or any related services ("Service"), you agree to these Terms and Conditions. If you do not agree, do not use the Service.

2. Description of Service

Tappy is a medication reminder and wellness check-in system. It includes a mobile app, a physical button device, and SMS/email/voice notifications. Tappy is not a medical device and does not provide medical advice.

3. Not a Medical Device

Tappy is a reminder tool only. It does not diagnose, treat, cure, or prevent any disease or medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or pharmacist regarding medication schedules.

4. User Responsibilities

• You are responsible for setting accurate reminder times
• You are responsible for obtaining consent from any buddy contact you add to the system
• You must provide accurate contact information
• You are responsible for maintaining your device's power and internet connectivity

5. Buddy Contacts

By adding a buddy contact, you confirm that you have their permission to share limited wellness check-in information with them. Buddy contacts will receive notifications about missed check-ins and confirmations only.

6. Emergency Features

The emergency alert feature contacts your designated contacts. It does not contact 911 or emergency services. Do not rely on Tappy as your sole means of requesting emergency help.

7. SMS and Communications

By using Tappy, you consent to receive SMS messages, phone calls, and emails related to the Service.

• Program Name: Tappy Medication Reminders
• Message Types: Medication reminder alerts, missed dose notifications, wellness check-in confirmations, buddy wellness alerts, and emergency notifications
• Message Frequency: Message frequency varies based on your reminder schedule. You may receive up to 10 messages per day.
• Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details.
• Opt-Out: You may opt out of SMS at any time by replying STOP to any message. You will receive one confirmation message and no further SMS will be sent.
• Help: Reply HELP to any message for support, or email rick@kithhealth.org.
• Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of purchasing or using the Tappy device.
• No Sharing: Your phone number and messaging consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes.
• Carriers: Carriers are not liable for delayed or undelivered messages.

8. Availability

We strive for reliable service but do not guarantee uninterrupted availability. The Service depends on internet connectivity, third-party services (Twilio, Firebase, HiveMQ), and device functionality. We are not liable for missed reminders or failed notifications due to outages, connectivity issues, or device failures.

9. Limitation of Liability

To the maximum extent permitted by law, Kith Health LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kith Health LLC from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason. You may stop using the Service at any time.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States.
